PROOF OF NOTICE TO SESSION 22 23 Upon the instruction of the Presiding Officer, the secretariat read both the request of the City 24 Mayor, Hon. Maila Rosario S. Ting-Que, and the members of the city council for the conduct of the special 25 session. 26 27 IV. ROLL CALL 28 29 With all members present, a quorum was declared. 30 31 V. FIRST READING (REFERENCE OF BUSINESS) 32 33 1. Indorsement of the City Mayor, Hon. Maila Rosario S. Ting-Que, on the request for an authority 34 to use the savings of the Tuguegarao City Government for the grant of one-time Service 35 Recognition Incentive (SRI) with a uniform rate not exceeding P20,000.00 to eligible government 36 employees pursuant to AO No. 27, series of 2024 dated December 12, 2024 issued by President 37 Ferdinand Marcos, Jr., certified urgent 38 39 After being recognized by the Presiding Officer, the City Budget Officer, Ms. Luthgarda Bingcang, 40 addressed the queries of some members. 41 A. There are savings under the Personal Services for the grant of SRI and the funding of which can be 42 through augmentation, to address the queries of the Presiding Officer. 43 B. The City Mayor is also requesting for an authority to utilize the savings for the grant of gratuity pay 44 to service contract and job order workers, her office just recently received the DBM guidelines, 45 there is no need to pass an appropriation ordinance by way of a supplemental budget since the

2 WHEREAS , the source of fund for the said Gratuity Pay shall be the Savings of the Tuguegarao 3 City Government; 4 5 WHEREAS , the release of the said Gratuity Pay shall be subject to the provisions of the 6 Presidential issuance from the Office of the President. 7 8 NOW , THEREFORE , RESOLVE , as it is hereby RESOLVED , to grant authority to the use of 9 the savings of the Tuguegarao City Government for the grant of Gratuity Pay to Contract of Service and 10 Job Order workers. 11 12 On joint motion, CITY RESOLUTION NO. 687-09-2024 was APPROVED under suspended 13 rules. 14 15 VI. COMMITTEE REPORT 16 17 1. Committee Report No. 284-2024 of the Committee on Human Resources and Development on the 18 recommendation of the Human Resource and Management Office regarding the amendment of 19 the 2025 Personnel Schedule 20 21 Hon. Arago presented the committee report below: 22 23 COMMITTEE REPORT NO. 284- 24 25 SUBJECT : 26 27 Indorsement of the City Mayor Hon. Maila Rosario S. Ting-Que, on the 28 recommendation of the Human Resources Management Office regarding the amendment 29 of the 2025 Personnel Schedule 30 31 FINDINGS : 32 33 1. Hon. Maila Rosario S. Ting-Que indorsed to the Ninth City Council the 34 recommendation of the Human Resources Management Office regarding the 35 amendment of the 2025 Personnel Schedule. 36 2. Ms. Ophelia Parallag, Supervising Administrative Officer of the Human Resources 37 Management Office, wrote a letter to the City Mayor recommending the following 38 revisions to the 2025 Personnel Schedule of the City Government to enhance efficiency 39 and effectiveness of its human resource management: 40 a. Transfer of Garbage Collector and Streetsweeper positions from the City General 41 Services Office (CGSO) to the City Environment and Natural Resources Office 42 (CENRO) with item numbers from 20.04 to 20.34 since CENRO's focus on 43 environmental management aligns with waste management and sanitation and to 44 comply to the requirements of our partner USAID. 45  There is no change of ranks, positions, benefits salaries and other renumeration 46 of the employees. 47 b. Placement of Livestock Auction Market and Slaughterhouse under the direct 48 supervision of the Mayor's Office in compliance with Ordinance No. 21- 49 along with the employees performing the duties as described in said Ordinance. 50  City Ordinance No. 21-2017 titled "Ordinance creating the Tuguegarao City 51 Livestock Auction Market and appropriating funds thereof.” 52  There is a need to permanently change the Plantilla of Livestock Auction 53 Market and Slaughterhouse from Department to Unit under the Office of the 54 City Mayor. 55 c. Revision of item numbers to streamline and make clearer the item numbers of all 56 positions in the City Government. 57  All old item numbers bearing letters shall be removed and such item shall 58 become numbers. 59 60 RECOMMENDATION : 61

1 After a thorough discussion, the committee favorably recommends the passage of 2 a Resolution approving the recommendation of the Human Resources Management Office 3 regarding the amendment of the 2025 Personnel Schedule. 4 5 After a resumption from a recess, the following were the replies of Ms. Ophelia Eduardene Parallag, 6 HRMO, to address the concerns of Hon. Bayona: the assignment of new plantilla numbers is different from 7 transfer or reassignment of employees, they are maintaining the plantilla of employees who were transferred 8 or reassigned except in the case of those whose positions will be transferred from the City General Services 9 Office (CGSO) to City Environment and Natural Resources Office (CENRO) and from City Mayor’s Office 10 to CDRRMO, and all the other employees will be treated as to their original positions. 11 12 After a brief discussion, the following were the amendments as agreed upon by the Body: to include 13 to the Findings that the matter was also referred to the Civil Service Commission and Local Finance 14 Committee and to remove Finding No. 2 (b) as introduced by Hon. Ortiz, and after the concurrence of Hon. 15 Ortiz and Hon. Ramirez, the report was adopted as amended upon the motion of Hon. Arago followed by 16 her presentation of the resolution. The Presiding Officer, thereafter, suggested to reflect therein the revisions 17 to the 2025 Personnel Schedule. 18 19 Subsequently, the following were the replies of Ms. Parallag to address the concerns of Hon. 20 Callangan about female employees whose position is administrative aide yet deployed as street sweepers: 21 there is no such an instance, they are using parenthetical descriptions as per DBM and CSC guidelines, all 22 utility workers shall be transferred to CENRO which is concerned of maintaining cleanliness in the city, 23 there can be job rotation but this entails an Order from the Local Chief Executive, she understands the 24 former’s concerns but they have to abide with CSC rules, to which Hon. Callangan raised, among others, 25 for the HRMO to look into the working conditions of said employees and then finally manifested her 26 approval on the matter with her condition that the working conditions of said employees will be improved 27 in succeeding year. The Presiding Officer, thereafter, advised Ms. Parallag to take note of Hon. Callangan’s 28 observations and to recommend this to the Local Chief Executive. 29 30 There being no further queries, on joint motion, the resolution below was approved under suspended 31 rules. 32 33 CITY RESOLUTION NO. 688-09- 34 35 RESOLUTION APPROVING THE AMENDMENTS OF THE 2025 PERSONNEL SCHEDULE 36 AS RECOMMENDED BY THE HUMAN RESOURCE AND MANAGEMENT OFFICE 37 38 Sponsors: Hon. Grace B. Arago 39 Hon. Restituto C. Ramirez 40 Hon. Ronaldo S. Ortiz 41 42 WHEREAS , the Supervising Administrative Officer of the Human Resource and Management 43 Office, Ms. Ophelia Eduardene M. Parallag, wrote a letter to the Local Chief Executive for the revisions of 44 the 2025 Personnel Schedule of the Tuguegarao City Government; 45 46 WHEREAS , the said letter was indorsed to the Ninth City Council by the City Mayor, Hon. Maila 47 Rosario S. Ting-Que; 48 49 WHEREAS , the matter was also referred to the Civil Service Commission and the Local Finance 50 Committee as stated in the letter; 51 52 WHEREAS , the revisions aim to enhance service delivery, improve coordination and oversight 53 and streamline operations; 54 55 WHEREAS , the amendments to the 2025 Personnel Schedule are the following: 56 57 1. The transfer of positions from the City General Services Office (CGSO) to the City Environment 58 and Natural Resources Office from Item Nos. 20.04 to Item Nos. 20.34 since CENRO’s focus is on 59 environmental management which is aligned with waste management and sanitation and to comply, 60 too, to the requirements of partner USAID.

AN ORDINANCE AMENDING SECTION 1 AND SECTION 3 OF CITY ORDINANCE NO. 17-

2002 TITLED "AN ORDINANCE REGULATING CERTAIN ACTIVITIES WITHIN THE

PREMISES OF THE TUGUEGARAO CITY AIRPORT

WHEREAS, Section 16 of Republic Act No. 7160, otherwise known as the Local Government Code of 1991, states that "Every Local Government unit shall exercise the powers expressly granted, those necessarily implied there from, as well as powers necessary, appropriate incidental for its efficient and effective governance, and those who are essential to the promotion of the general welfare";

WHEREAS, Memorandum Circular No. 023-2024 of the Civil Aviation Authority of the Philippines (CAAP) titled "Amendment to Philippine Civil Aviation Regulations Air Navigation Services (CAR-ANS) Part 15 Adopting Amendment 43 to ICAO Annex 15- Aeronautical Information Services," particularly, 15.5.3.3.4 - For aerodromes regularly used by international civil aviation,-additional terrain data should be provided within Area 2 (b) within the area between 10 km and the Terminal Maneuvering Area (TMA) boundary or a 45 - km radius (whichever is smaller);

WHEREAS, Hon. Bienvenido C. De Guzman II sponsored a Draft Ordinance Amending City Ordinance No. 17-2002 Regulating Certain Activities within the Premises of the Tuguegarao City Airport which was included in the agenda of the 109th Regular Session of the Ninth City Council and was referred to the joint committee on transportation as the lead committee and Committee on Rules, Laws and Ethics;

WHEREAS, after a deliberation in a committee meeting held for the said putpose, the said Committees found the request to be in order and beneficial to the constituents of Tuguegarao City;

WHEREAS, after the approval of the concomitant committee report, the Ninth City Council during its 121st Regular Session held on January 14, 2025 deemed it proper and necessary to approve the herein ordinance.

NOW, THEREFORE, be it ORDAINED by the Sangguniang Panlungsod, in session assembled, to enact:

SECTION 1: TITLE This Ordinance shall be known as ORDINANCE AMENDING SECTION 1 AlVD

SECTION 3 OF CITY ORDINANCE NO. 17-2002 TITLED 'WV ORDINA1VCE REGULATING

CERTAIN ACTIVITIES WITHIN THE PREMISES OF THE TUGUEGARAO CITY AIRPORT.

SECTION 2. AMENDMENTS:

Section 1 and Section 3 of Ordinance No. 17-2002 shall be amended to read as follows:

Section 1. No kite or kites, pigeons, drones and balloons and any other flying gadgets shall be flown or caused to be flown within the radius of ten (10) kilometers from the center of the Tuguegarao City Airport.

Section 2. No person, vehicle or animal shall, without the permission from the Civil Aeronautics Administration Office, enter or loiter or be allowed to enter or loiter within the runway premises of the Tuguegarao City Airport and other designated areas thereof to which entry is prohibited by said Office.

Section 3. Any person who violates the provision of this Ordinance shall be fined: First Offense — a fine of One thousand pesos (P1,000.00) Second Offense — a fine of Three thousand pesos (P3,000.00) Third Offense — a fine of five thousand pesos (P5,000.00) Section 4. For purpose of enforcement, the Air Transportation Office shall be deputized to implement the ordinance.

SECTION 3. SEPARABILITY CLAUSE. (^) If for any reason, any provision of this Ordinance is declared invalid or unconstitutional, the remaining provisions not affected thereby shall remain and continue to be in full force and effect.

SECTION 4. REPEALING CLAUSE. (^) Any resolution or ordinance or part thereof not consistent with the provision of this ordinance is hereby repealed.

SECTION 5. EFFECTIVITY CLAUSE. This Ordinance shall take effect upon its approval.

I would like to formally request for the Renewal of a Legislative Franchise to Operate the Dupaya Recreation Center which is set to expire sometime on August 30, 2025.

The Dupaya Recreation Center, has all the qualifications and none of the disqualifications to operate and maintain, for recreational and commercial purposes, a cockpit within Tuguegarao City, having maintained and complied with all the requirements of Ordinance No. 08-2005, otherwise known as "The Cockfighting Ordinance of 2005."

MEMORANDUM OF AGREEMENT FOR WORK IMMERSION PARTNERS FHP

This Memorandum of Agreement is entered into this of January, 2025 in Tuguegarao City by and between:

The UNIVERSITY OF CAGAYAN VALLEY-SENIOR 'UGH SCHOOL, with School Identification Number 400548 a private high school, with principal address at BALZAIN, TUGUEGARAO CITY, represented in this Agreement by its UNIVERSITY PRESIDENT, ESTHER SUSAN N. PEREZ-MAR1, MSc-FM, MD, PhD, FILIPINO of legal age, and hereinafter referred to as the SCHOOL;

The TUGUEGARAO CITY HALL of the Republic of the Philippines, with principal address at CARIG SUR, TUGUEGARAO CITY, CAGAYAN, represented in this agreement by its CITY MAYOR, HON. MAILA ROSARIO TING-CUE, FILIPINO, of legal age, hereinafter referred to as the "LGU",

WITNESSETH:

WHEREAS, the Department of Education of the Philippines, hereinafter referred to as "DepEd", is the primary government instrumentality mandated to formulate, implement, and coordinate policies, plans, programs and projects in the areas of formal and non-formal basic education; supervise all elementary and secondary' education institutions, including alternative learning systems, both public and private; and provide for the establishment and maintenance of a complete, adequate, and integrated system of basic education relevant to the goals of national development;

WHEREAS, the DepEd has introduced the K to 12 basic education reform program that includes Senior High School, hereinafter referred to as "SHS", with the major objective of ensuring that graduates of basic education are ready for employment, entrepreneurship and higher learning;

WHEREAS, the SHS eturiculum can be customized at the local levels to take into consideration the needs of local industriea and the labor market;

WHEREAS, DepEd believes that for the effective delivery of SHS instruction, there is a need for school-industry pal tnerships that will provide the school the necessary expertise and venue for practical, on-the-job, enterprise-based training for SHS learners;

WHEREAS, DepEd will start full implementation of SHS in School Year 2024-2025;

WHEREAS, the SCHOOL is among those that will offer SHS to students in the community to carry out DepEd.'s objectives for SHS as spelled out above;

WHEREAS, to achieve this objective, the SCHOOL needs to enter into a Work Immersion

Partnership with the LGU;

VVHEREAS, the LGU operates in the area where the School is located and has offices, facilities, project sites, and expertise that it can make available to the School for purposes of student work immersion;

WHEREAS, the LGU considers going into a work immersion partnership with the School as part of its mission to create a positive impact on the coinrnunity, especially the young people;

WHEREAS, the LGU institutionalization and implementation of the K to 12 program is among the priority programs of the Government for promoting inclusive growth;

WHEREAS, the LGU encouraged to fully support the successful implementation of the K to

12 program of the Department of Education as stated in Paragraph 4, Section 2 of the Republic

Act 9155 or "Governance of Basic Education Act of' 2001",

WHEREAS, the LGU recognizes the need for a work immersion environment that is safe for

the students and teachers, and conduciv-e to learning, and has the capability to provide these;

VVHEREAS, the SCHOOL and the LGU, hereinafter collectively referred to as "the

PARTIES", undertake to collaborate toward the successful implementation of the SHS in

cognizant of the need for special protection of the child and with the best interest of the SHS

learner at heart;

NOW, THEREFORE, for and in consideration of the foregoing premises, the PARTIFS

hereby agree as follows:

DESCRIPTION OF THE WORK IMIVIERSION PROGRAM

With the passage of the Enhanced Basic Education Act of 2013 or Republic Act 10533, the

DepEd was tasked to implement the K to 12 Program, essentially adding two (2) years of

specialization within the Basic Educational System;

DepEd designed the implementation of RA 10533 within the framework of increased

community involvement in the learner's experience;

With this premise, the DepEd, offers venues for various stakeholders to participate in the

implementation of RA 10533 and, the same offer, accepted by the PART1ESs herein;

The Work Immersion Program is one of the course requirements for graduation. A SHS

student has to undergo work immersion in a business organization or establishment with work

requirements related to the specialization. Through work immersion, the students are exposed

to and are familiarized vvith the work-related environment related to their field of

specialization. Specifically, the students are able to:

1.Appreciate the importance and application of the principles and theories learned in school.

2. Enhance their technical knowledge and skills.

3. Enrich their skills in communications and human relations.

4. Develop good work habits, attitudes, appreciation and respect for work.

I. OBJECTIVES OF THE WORK EVIIVIERSION PARTNERSHIP

The Work Immersion Partnership has the following objectives:

1.To supplement the formal curriculum ofthe SHS program with special inputs coming t'rom

the LGU experts and practitioners in order to make the SHS program alig,ned and consistent

vvith work standards;

2. To develop in the students of the SHS program the knowledge and skills that are relevant

to the needs of the job market in the area

3. To provide SHS students relevant learning experiences by giving them exposure to the

actual workplace setting.

4. To form Work hnmersion Partnership between the SCHOOL and the LGU, allovving the

students, faculty, and staff of the schools concerned the use of and access to the COMPANY

workplace and equipment as part of their Work Immersion Program.

11.Provide the LGU a Certificate of Participation in the SHS program for whatever purpose

it may serve.

12.Execute a deed of acceptance as a way of recognizing and acknowledging the donation/s

received from the LGU.

C. The LGU shall:

1. Assign a competent Immersion Coordinator from the LGU to liaise with the School and

supervise the students without prejudice to the special parental authority of the school, its

administrators and teachers for the duration of the Work Immersion program so as to ensure

efficient implementation of all stages of the program.

2. Provide inputs into the curriculum through the discussions or workshops that DepEd will

organize.

3. Lend its expertise by making available its resident resource persons to provide training to

the students.

4. Allow the students to be deployed to the different sections/departments/project sites of the

LGU based on the Work Immersion Daily Schedule of Activities.

5. Agree to the required number of hours of the immersion program set under the DepEd SHS

curriculum. (See Annex A of the Guidelines)

6. Provide immersion opportunities for 58 students for School Year 2024-2025.

7. Provide students with an orientation about the LGU, its line of business, and the work its

employees do, and expose them to the various stakeholders of the community in which the

LGU operates for the students to get a holistic understanding of its business.

8. Similarly ensure that students undergo training related to their course, and provide the

students with work or activities based on the activities listed in the prescribed template for the

Immersion Program of Activities (Annex C of the Guidelines).

9. Make its workplace and facilities available to students, and shall similarly take all necessary

action to ensure the safety of students within their areas of operation at all times, which shall

include, but shall not be limited to, the provision for Personal Protective Equipment (PPE's),

if applicable. Ensure that the students will not be exposed to hazardous materials and working

environment throughout the duration of the immersion.

10. Evaluate students' performance in the immersion venue by accomplishing provided

evaluation tool.

11.Issue a Certificate of Completion to the student trainees upon satisfactory compliance with

all requirements of the program.

12. Execute a deed of donation in favor of DepEd for the completed Work Immersion

Partnership.

III. EFFECTIVITY

This agreement shall hold for the duration of the 2024-2025 Academic School Year and is

renewable every year. The LGU and the SCHOOL shall submit their intention for renewal of

this agreement through thrmal notice within thirty (30) days before the expiration of this

Agreement.

The LGU and the SCHOOL reserve their respective rights to terminate their participation in

the agreement through formal written notice within thirty (30) days before the effectivity- of

the termination. Bath parties shall turnover all deliverables agreed thereto in them Work

Immersion Program. Termination shall be subject to the mutual agreement betvveen the parties.

A material breach of the Work Immersion Guidelines and/or this MOA shall constitute a ground for termination of the MOA, in whole or in part, by the aggrieved party, without prejudice to other legal remedies.

IV. LIAIIILITY

The school, its administrator and teachers exercising authority and supervision over the Senior High School Student tmdergoing immersion in the premises of the partner may be held accountable for the student's acts.

Each party shall answer for losses and damages arising from any accident, act, or omission directly attributable to its fault or negligence, which may cause death or bodily injury to any persons, or loss or damage to property, by or on account of the performance of the respective obligations by the parties ptu-suant to this Agreement. Such responsibility shall continue to remain tha,t of the responsilale party'a even after the. termination of /kis, agreement, if such losses and damages were incurred during the effectivity of this agreement.

DepEd shall not be liable for opportunity losses of the LGU during the duration and a.fter the termination of this agreement.

The Second Party shall exereise the diligence of a good father of family in the supervision of the field instruction students while under its care and tutelage. The degree of diligence required by law shall be exercised by booth parties.

V. NON-DISCLOSURE PRO VISION

It is expressly understood by DepEd and the students that all information on technology, manufacturing process, process standards, quality assurance methodologies, quality standards, production capabilities, raw material purchasing, marketing, finance, and all other related documents, .manuals, operational and technical matters that the LGU shall make available to them shall be used for the sole purpose of student -training. All of these matters are classified as confidential in nature and proprietary to the LGU and thereby each student hereby un.dertakes to prevent transfer of such information by any of its members to any party outside of the LGU.

VI. OWNERSHIP OF OUTPUT AND INTELLECTUAL PROPERTY

Intellectual properties develop by the student as part of his or her regular Work Immersion duties in the Company and their corresponding copyrights and/or patents shall belong to the COWANY.

Intellectual properties developed by the student outside of his or her regular work immersion

duties in the LGU and their corresponding eopyrights arid/or patents shall belong to the

student, even if the student used the time, facilities, materials of the LGU, unless otherwise
stipulated in a separate agreement between the student an.d his or her parent or guardian andi

the LGU.

The above provision shall apply in proportion to the intellectual properties developed by the

student in ease intellectual property is jointly developed by the student with employee or

personnel of the LGU, unless otherwise stipulated in a separate agreement between the student

and his or her parent or guardia.n and the LGU.

VH. OT H ER PROVISIONS

It is expressly understood by the PART I S that the LGU is not obliged to pay wage or salary

since there is no employer-employee relationship that exists. However, the LGU is not
