UNIT II: RISK ASSESSMENT AS APPLIED TO SAFETY AND SECURITY
Module 1. IDENTIFICATION OF SAFETY AND SECURITY REQUIREMENTS
Republic act 11058: Strengthening Compliance with Occupational Safety and Health
Standards and Providing Penalties for Violations Thereof.
BREACH: (of legislation or policy) is the breaking/failling to comply with legislation or
policy (non-compliance)
CIVIL LAW: Applies to situations where individuals or organizations take action against
another person or organization for breaching statutory law.
CRIMINAL LAW: Applies to situations where the state takes action against a person or
organization for breaching statutory law.
VICARIOUS LIABILITY: is the legal liability falling to the employer for the actions of their
“agent
(Their staff/employees) based on the principle the employer is responsible for the
actions of their employees.
Article XIII ,Section 3: Article XIII, Section 3 of the 1987 Constitution affirms that, "The
State shall afford full protection to labor, local and overseas, organized and unorganized,
and promote full employment opportunities for all.
