A LAW STUDENT’S VIEW ON THE RECENT ELECTIONS
The 2025 national and local midterm elections in the Philippines have
just ended, the culmination of the candidates’ months long effort and hard
work in campaigning and convincing the people to vote for them have yielded
its results. Some old and familiar names were left in defeat, while some fresh
and new ones were elected into office. Some people are full of joy as their
picks got a seat, while some frown as the candidates they supported and voted
failed to succeed. It is safe to say, that the recent local and national midterm
elections proved to be a game changer as we saw the return of two opposition
candidates who unexpectedly performed well, namely Senator Aquino and
Senator Pangilinan who will undoubtedly be part of the Minority in the
Senate. Notable mentions who also won in the Congress include former
Senator De Lima, who is the 1st nominee of Mamayang Liberal (ML) Partylist
and Atty. Diokno who ran under the Akbayan Partylist, both of whom which
were called upon to be part of the Prosecution panel regarding the
impeachment complaint against Vice President Duterte.
Regrettably however, we still saw the rampant peddling of fake news,
vote buying and vote selling, election related violence, the usual difficulties
and inefficiencies experienced by the voters during the election day and many
more. Because of this, a lot of people’s choices were influenced especially the
poor and illiterate who are very much prone to exploitation, and only a handful
of candidates with clear platforms and impressive qualifications were able to
have success in winning even though they do not have a large political
machinery, not resorting to vote buying and not having the same resources or
capabilities unlike the old and traditional politicians, as what we have been
able to observe in the case of former Vice President Robredo who is now the
Mayor of the City of Naga and Mayor Sotto of Pasig City to name a few.
Despite the abovementioned circumstances, the Commission on
Elections (COMELEC) did not declared failure of elections. Some political
experts and civil society groups even saw that this midterm elections is a
turning point in the current administration. Most especially with the on-going
impeachment against the sitting Vice President, the would-be allies and
enemies of President Marcos will greatly affect the outcome of such
impeachment, not to mention that majority of the members of the Prosecution
panel in the lower house were able to secure their seats, with addition of two
brilliant opposition candidates in their team and also the inclusion of two more
opposition candidates in the Senate who will form part of the minority.

On another note, the situation in the local elections seemed not to change at all or maybe even worsened. The same names and families coming from Political dynasties won again and even secured additional seats for expansion. Let us not look any further, one very good example is the Villafuertes in Camarines Sur who continued to remain dominant in the province for decades, if not a century already. The clan’s patriarch, Lray Villafuerte through various kinds of means and machinations, extended their dynasty once again against the neophyte yet more qualified candidate, Bong Rodriguez. The gubernatorial elections can be considered a close fight since this is the first time that the latter ran for office and despite only having a volunteer-led campaign and his platforms, he was able to go toe-to-toe initially against the former who had all the political machinery, the resources and means to launch a full campaign including alleged fake news peddling, vote buying, violence or intimidation, and even among others to deceive and attract the voters especially the youth to vote in their favor. Sometimes one may ask, why is it that there is still no law enforcing the Anti-Political Dynasty provision in the constitution? Furthermore, why is it that there are no additional qualifications for people running in public office especially in the national elections? And why is it that lawyers need to have a law degree before they can practice law but lawmakers who create laws need not have law degree or even just a college degree? But then we are reminded by the Supreme Court in Geronimo v. Ramos which stated that: “The importance of the people's choice must be the paramount consideration in every election, for the Constitution has vested in them the right to freely select, by secret-ballot in clean elections, the men and women who shall make laws for them or govern in their name and behalf. The people have a natural and a constitutional right to participate directly in the form of government under which they live. Such a right is among the most important and sacred of the freedoms inherent in a democratic society and one which must be most vigilantly guarded if a people desires to maintain through self- government for themselves and their posterity a genuinely functioning democracy in which the individual may, in accordance with law, have a voice in the form of his government and in the choice of the people who will run that government for him.” With this pronouncement arises a question as to where do we draw the line now between the people’s freedom to choose who will lead them and the spirit of the law regarding the welfare of the people which is considered as the supreme law in having a qualified, capable, and responsible leaders? How do we now balance the two sides, find a common ground, and create a win-win solution? As of now, it is impossible to find the answer considering the current political landscape that we have which undeniably favors those who benefit from such ambiguity or unsettled provisions of the law. Maybe someday, we would be able to find the answer and witness the drastic changes we badly needed in our society. For now, these questions, will remain unanswered.
