REPUBLIC ACT NO. 9208 "ANTI-TRAFFICKING IN PERSONS ACT OF 2003 AS AMENDED BY R.A. NO. 10364 (THE EXPANDED ANTI-TRAFFICKING IN PERSONS ACT OF 2012) AND FURTHER AMENDED BY R.A. NO. 11862 (THE EXPANDED ANTI-TRAFFICKING IN PERSONS ACT OF 2022)

Trafficking in Persons (TIP)

The recruitment, transportation, transfer,

harboring, adoption or receipt of a child for

the purpose of exploitation or when the

adoption is induced by any form of

consideration for exploitative purposes shall

also be considered as “trafficking in persons.

is an illegal act and is considered a violation

of human rights and inimical to human

dignity and national development.

PROSTITUTE

Any person found guilty of any of the offenses covered by

this articles shall be punished by arresto menor or a finenot

exceeding 200 pesos, and in case of recidivism, by arresto

mayor in its medium period to prision correccional inits

minimum period or a fine ranging from 200 to 2 , 000 pesos,

or both, in the discretion of the court

Women who, for money or profit, habitually indulge in sexual intercourse or lascivious conduct, are deemed to be prostitute. (Art. 202 of RPC)

PIMP is one who controls the actions and lives off the proceeds of one or more prostitutes. ( Williamson & Cluse-Tolar, 2002 ; Dalla, 2002 )

    • Receipt of persons
    • Adoption/ Birth Simulation (WITH or WITHOUT the victim's consent or knowledge, WITHIN or ACROSS national borders)

THE PURPOSE (Why is it done?)

  • Prostitution/sexual exploitation
  • Pornography
  • Forced labor or services
  • Slavery
  • Removal or sale of organs
  • Debt Bondage
  • Armed Activities

ACTS THAT PROMOTE TRAFFICKING IN PERSONS

CASE FILING: The case can be filed where:

  • the offenses were committed;
  • any of its elements occurred; or
  • the trafficked person actually resides at the time of the commission of the offense

CASE FILING:

  1. The trafficked person;
  2. The trafficked person’s:
    • Parents
    • Spouse
    • Siblings
    • Children, or
    • Legal guardian;
  3. Anyone who has personal knowledge of the commission of an offense under RA 10364

SPECIAL AMENDMENTS TO R.A. 9208

  1. Accessories- Whoever has the knowledge of the commission of the crime, and without having participated therein, either as principal or as accomplices, rake part in its commission in any manner provided by the law.
